Eric Gertner is a partner in our Litigation Group in Toronto. As such, he is versed in recent legal developments in a multitude of legal areas. Mr. Gertner has special experience in debtor-creditor law, constitutional law (particularly freedom of expression) and professional liability. He also has significant experience with class action litigation. In his role as the firm's director of research, he has participated in a number of landmark commercial and constitutional cases and has provided legal advice on significant commercial transactions. Mr. Gertner was one of the two founding co-editors of The Supreme Court Law Review (now in its 20th year of publication). He has co-authored the leading Canadian casebook on debtor-creditor law and has co-edited a number of other publications. Prior to joining the firm in 1984, Mr. Gertner was a staff lawyer with the Ontario Law Reform Commission for more than five years. During that time, he participated in the research, writing and editing of the Commission's Report on Class Actions (1982). The Commission's recommendations became the foundation for Ontario's Class Proceedings Act. Since the introduction of the Ontario Act, Mr. Gertner has acted as a legal adviser in a number of class proceedings, including Bre-X and Anderson v. Wilson. The latter is the first certification decision to be substantively reviewed by the Ontario Court of Appeal. Mr. Gertner received his LLB from Osgoode Hall Law School, York University and his BCL at the University of Oxford, England. He was called to the Ontario bar in 1977. |
