Eric is an attorney in the firm's Bankruptcy and Creditors' Rights Group and his practice is focused primarily on litigation and contested matters that arise in bankruptcy. Eric has represented debtors, creditors committees and secured lenders in some of the largest bankruptcy filed in Delaware and the surrounding jurisdictions.
Eric focuses his practice to the representation of financial institutions, hedge and private equity funds, alternative investment managers and institutional investors in complex litigation and commercial transactions in many prominent bankruptcy cases on issues such as debtor-in-possession financing, corporate governance, successor and lender liability, asset sales (including intellectual property), contract disputes, avoidance actions and plan confirmation.
Eric has handled and litigated matters involving a broad range of industries including technology, energy, real estate, employment, pension and retirement issues and fiduciary obligations which often involves the representation of insiders and third-party professionals such as accountants, auditors, lenders and advisors against claims by the bankruptcy estate. Eric earned a certification in employee benefits law from the Temple University School of Law and represents employee benefit plans and their trustees that manage institutional capital, pension funds concerning executive compensation, deferred compensation, severance and ERISA litigation in the context of bankruptcy.
Eric also represents claimants in many of the mass tort bankruptcies filed in Delaware and the surrounding jurisdictions. Eric represents lenders, insurers and other environmental claimants to initiate claims for potential coverage and handles disputes over alleged coverage exclusions that arise as a result of the intersection between bankruptcy court rules, environmental regulations and insurance policy provisions. Further, Eric is experienced in handling issues relating to the responsibilities of a debtor, debtor-in-possession or trustee, to comply with environmental laws, the dischargeability of environmental claims and the application of injunctive relief. In addition, he provides advice to a broad spectrum of clients on aspects of environmental law, including hazardous and solid waste issues, waterfront development and wetland matters, as well as, advising landowners, developers, landlords, contractors and suppliers to defend their rights in bankruptcy.
Prior to joining the firm, Eric served as the sole law clerk to the Honorable Mary Pat Thynge, United States Magistrate Judge for the United States District Court for the District of Delaware.
