Areas Of Experience
Commercial and Products Litigation
In Ms. Ginsberg's commercial litigation and products liability practice, she has represented an international motor carrier; manufacturers in the aviation industry, including aircraft, engine and other component manufacturers; medical device development consultants, distributors, and manufacturers; an e-commerce consulting company; automobile manufacturers; manufacturers and distributors of industrial equipment, consumer products, and chemicals; employers' interests in restrictive covenant disputes; small businesses' interests in partnership and shareholder disputes; and insurance companies' interests in coverage disputes. Some of Ms. Ginsberg's representative matters include:
· Trial counsel for a bank in a matter involving the repossession of a Learjet aircraft, where the central issue in the trial was whether the bank's refurbishment and sale of the aircraft was consistent with commercially reasonable standards in the aviation industry.
· Counsel for an aviation component part manufacturer in a matter involving the crash of a Spanair aircraft in Spain, following which suits were filed by decedents' representatives in California. Ms. Ginsberg identified and developed arguments relating to choice of law between Spain, California, and the several states where plaintiffs and defendants resided.
· Trial counsel for an orthopedic device manufacturer and its regional sales representative in a trademark, unfair competition and contract dispute with a former sales representative, resulting in a jury verdict in the clients' favor, including an award of punitive damages.
· Lead counsel for an e-commerce consulting company and its president defending against a former employer's allegations of breach of a non-competition agreement, defeating the former employer's request for a preliminary order restraining her clients' business activities.
· Counsel for a small business in litigation brought by minority shareholders seeking unrestricted access to accounting and financial records in which the trial court granted the shareholders' broad pre-complaint demand for inspection of records. Ms. Ginsberg pursued an appeal of the trial court's order to the Superior Court of Pennsylvania, overcoming the shareholders' motion to quash the appeal as interlocutory and obtaining an order from the Superior Court staying the trial court's order, which resulted in a voluntary withdrawal of the shareholders' demand and a subsequent negotiation for the production of a very limited scope of records.
· Counsel for an elevator installation subcontractor in a litigation brought by a general contractor seeking indemnification for injuries sustained by an employee of the elevator subcontractor. The matter involved complex questions of law regarding the scope of indemnification to which the general contractor was entitled, resulting in the trial court siding with the elevator subcontractor and substantially limiting the general contractor's right of recovery.
· Defense counsel for an international motor carrier in catastrophic and high exposure litigation matters in various jurisdictions around the country.
· Lead counsel for a franchise company in an action against a former franchisee who was in breach of the franchise agreement's non-competition clause by operating a competing business at the site of the former franchise business. Ms. Ginsberg obtained injunctive relief for the company, restraining the former franchisee's competitive business activities.
