Reported CasesRepresentative Matters: Malpractice Suit Against Nursing Home Dismissed; The trial court in New Britain granted a motion to dismiss in an lawsuit alleging that the plaintiff suffered a broken arm as a result of the defendant's employees using improper techniques to lift him while recording his weight. The motion to dismissed argued that the claims of negligence against the nursing home sounded in medical malpractice, rather than ordinary negligence, and that the plaintiff failed to attach a written opinion of a similar health care provider as required by Connecticut law to bring a lawsuit for medical malpractice. Evan O' Hara handled this matter.; Emergency Room Physician Defended in Wrongful Death and Loss of Consortium Action; Timothy Grady and Evan O' Hara recently successfully defended an Emergency Medicine physician and his practice group in a wrongful death and loss of consortium action brought by the estate and husband of a 34 year old woman who presented on multiple occasions to a local hospital Emergency Department over the course of several years with complaints of chest pain before suffering a fatal myocardial infarction. After a month-long trial the plaintiff's attorneys asked the jury to return a verdict of $4.7 million. After two-and-a-half days of deliberations the jury returned a defense verdict.
