Evelyn is a partner and co-Practice Group Leader in the firm's Employee Benefits & Executive Compensation Practice Group. She represents large public and privately held companies in a broad array of employee benefits and executive compensation matters including tax qualified plans, employee health and welfare plans, severance arrangements and non-qualified deferred compensation. With over 30 years experience, Evelyn brings an in depth knowledge of the laws, the governmental agencies that enforce them and extensive practical experience in addressing the day to day issues that arise in the design and administration of employee benefits.

Representative Experience

Counsel to various large and mid-size businesses, both taxable and tax exempt, in matters relating to tax qualified retirement plans including defined benefit and cash balance plans and all forms of defined contribution plans (including 401(k) plans and Roth accounts), welfare plans, including self-insured medical and disability plans, compliance with HIPAA privacy and security rules including electronic security and breach notification, executive compensation and FICA taxation of deferred compensation.

Counsel to Virginia Retirement System in matters relating to tax qualified governmental retirement plans and deferred compensation plans under IRC Section 457 including advice to various localities on matters including IRC 403(b) plan audit and FICA taxation of pick up contributions.

Counsel to U.S. subsidiary of German and French companies in matters relating to U.S. tax qualified plans and unique issues involving non-resident aliens, controlled group testing and service issues.

Counsel to large agricultural cooperative, sponsor of multiple employer defined benefit and defined contribution plans and multiple employer welfare arrangement.

Counsel to Virginia trade association sponsoring master tax qualified retirement plans and multiple employer welfare plans.

Counsel to cities of Roanoke, Charlottesville, Richmond, and Virginia Beach, Virginia, and political subdivisions in employee plan matters and welfare benefit matters.
