Faegre & Benson handles housing and community development projects throughout the United States, with a focus on the Rocky Mountain and Upper Midwest regions.
Clients. Our clients include for-profit and non-profit developers, investors, owners, lenders, investment bankers, and governmental entities, including state agencies, cities, and counties. We have been involved in small niche projects, as well as major housing developments involving several hundred to more than one thousand units.
Cross-disciplinary team. We draw on the expertise of a cross-disciplinary team with experience in land use and government approvals, environmental reviews and permitting, tax, public finance, lending, and construction.
We handle the full range of housing and community development issues, including:
Mixed-use development. Our attorneys have worked on some of the most unique mixed-use developments in the country. We have extensive experience solving the land use, financing and subdivision issues related to diverse uses. Projects have combined rental and for-sale housing with medical clinics, hotels, libraries, retail and restaurants.
Low-Income Housing Tax Credit (LIHTC). Our lawyers have worked on more than 300 LIHTC transactions.
Historic redevelopment. Our lawyers focus on creative approaches to historic tax credit transactions, including the 10% and 20% federal credit, sandwich leases and façade easements.
New Markets Tax Credit. We handle complex transactions utilizing New Markets Tax Credits, representing developers, investors and lenders.
Multiple financing sources. Combining various financing sources is common in our work. We have represented developers on projects with HUD financing, including 221(d)(3), 202, Section 8, CDBG, HOME, tax increment, tax abatement, general obligation bonds, 501(c)(3) bonds, housing revenue bonds and conventional financing.
Housing in Indian country. We have worked on more LIHTC transactions on Indian land than any other firm in the country.
