Biography

Professional Experience

Mr. Prugo, a partner in our New York office, is a trial attorney practicing patent litigation with a focus on prescription pharmaceuticals and biologics. Mr. Prugo has extensive experience leading trial teams on behalf of pharmaceutical industry leaders and has appeared as lead trial counsel in the federal district courts of Delaware and the Northern District of Illinois.

In addition to his work on behalf of the firm's litigation clients, Mr. Prugo is committed to Pro Bono assistance and has successfully represented clients against the New York City Housing Authority.

· Genzyme Corporation, et al. v. Eagle Pharmaceuticals, Ltd. et al. (D. Del.) (consolidated) Lead trial counsel (along with Scott Reed) for Genzyme in an ANDA litigation relating to Hectorol® (vitamin-D analog used in the treatment of dialysis patients). Five-day bench trial held November 2011.

· Genzyme Corporation, et al. v. Pentech Pharmaceuticals, Inc., et al. ( N.D. Ill.) Lead trial counsel (along with Scott Reed) for Genzyme in an ANDA litigation relating to Hectorol®. Twelve-day bench trial held October-November 2010.

· Bristol Myers Squibb adv. The Regents of the University of Michigan, et al. ( E.D. Mich. & Fed. Cir.) Represented BMS in an inventorship challenge by the University of Michigan and Repligen Corp. in connection with therapeutic fusion proteins important in the regulation of the immune system.

· Novartis Pharmaceuticals Corp., et al. v. Abbott Laboratories (D. Del.) Represented Novartis in a patent infringement jury trial involving cyclosporine.

· Novartis Pharmaceuticals Corp. et al. v. Mylan Pharmaceuticals, Inc., et al. (D. N.J.) Represented Novartis in an ANDA litigation involving FEMARA®.

· Bayer Schering AG, et al. v. Barr Pharmaceuticals, Inc., et al. (D. N.J. & Fed. Cir.) Co-counsel for Bayer Schering in an ANDA litigation involving YASMIN®.

· Genzyme Corp. v. Impax Laboratories, Inc., et al. (D. Md.) Lead trial counsel for Genzyme in an ANDA litigation involoving Renagel® and Renvela®.
