We know that to wisely counsel our clients in business disputes requires understanding our client's business, its competitive and financial position, and its goals, as well as the motivations and claims of its adversary, and the likely appeal of the case to a judge or jury. We may, for example, advise our client to refrain from all-out litigation if business reasons trump the advantages of the lawsuit. In other cases, the realities of the business setting may lead us to advise prompt litigation to resolve an intractable and important problem. Though we are trained to try cases, we understand the costs and limitations inherent in the litigation process and know that the courtroom is not a panacea for all disputes. We will consider sensible and alternative means for resolving the conflict.
Whatever our conclusions, we strive to work with our clients to formulate collaborative strategies that combine our clients' knowledge, experience, and wisdom with our own. We listen to our clients before advising them because we know there is no substitute for a deep understanding of business transactions in general, and a true feel for the client's needs in particular.
