Fulbright & Jaworski's Trusts and Estates Practice Group handles a range of legal matters of interest to private clients involving tax-sensitive estate planning and estate administration, trust administration, charitable gift planning, advice for charitable organizations and related planning and litigation matters. Clients served by our group include individuals, closely-held businesses, charitable organizations, and private client service group of financial institutions.

Trusts and Estates: Estate Planning

  • Fulbright & Jaworski prepares wills and trusts that provide effective disposition of personal wealth during life and after death.
  • Our team provides legal advice about income, estate, gift, inheritance and generation-skipping taxes.
  • We provide legal advice regarding estate planning through inter vivos gifts, insurance planning, various "estate freezing" techniques and charitable gift planning.
  • Our attorneys organize and aid in the administration of closely-held entities, family limited partnerships, limited liability companies and corporations, including the implementation of buy-sell agreements and employee benefit planning.
  • When necessary, our attorneys represent clients before the Internal Revenue Service in various estate and gift tax matters.

Trusts and Estates : Estate Administration

We represent executors in probating decedents' wills and administration of descendent's estates and provide a broad array of legal services relating to transactions arising during estate administration. Our practice also involves estate and income tax planning for decedents' estates, surviving spouses and beneficiaries of estates.

Trusts and Estates: Trust Administration

We advise trustees on proper actions when questions arise during trust administration and provide tax planning for trusts and their beneficiaries. Notably, our attorneys are active in designing and implementing generation skipping trusts, insurance trusts, charitable trusts and management trusts, and modifying and reforming such trusts to comply with changes in law and circumstances.

As an adjunct to Fulbright & Jaworski's estate planning and estate administration work, the Trusts and Estates Practice Group has developed special skills in handling controversies related to trusts and estates and court proceedings involving same. In addition, our Group counsels in various peronsal areas, including marital property agreements, powers of attorney, designations of guardian, and techniques for providing health care and property management for incapacitated or elderly clients or relatives of clients.
