    Biography

    Gary has specialized in litigation and insurance matters for over 30 years and is a recognized expert in matters pertaining to directors and officers liability insurance and other forms of professional liability coverage. He has represented insurers in thousands of matters pertaining to professional liability insurance, including many of their highest profile and most significant matters. Gary has litigated cases on behalf of insurers in trial and appellate courts throughout the country. He counsels insurance clients regularly with respect to claims and underwriting matters. He has lectured and written articles about directors and officers liability insurance issues and exposures faced by directors and officers.

    Gary currently represents insurers in matters involving subprime lending, auction rate securities, backdating stock options, ERISA stock drop suits, employment discrimination, insurance industry contingent commissions, antitrust, healthcare, criminal and regulatory investigations, and coverage litigation. He has represented insurers in connection with more than 600 securities class actions and hundreds of derivative actions. Gary represents insurers in dozens of mediations each year.

    Gary is ranked in the highest tier of Insurance lawyers Nationwide and in the District of Columbia by Chambers USA, which writes, "Clients are effusive in their praise: 'He has an extremely deep understanding of the marketplace and is phenomenal at representing us,' reported one."     Represented D&O insurers in dozens of claims involving bank failures and savings and loan failures.

    Represented outside director in securities lawsuit.

    Represented architects and engineers in professional liability lawsuits.

    Represented law firm in professional liability lawsuit.

    Testified as expert witness in reinsurance arbitrations.

    Represented insurers in coverage and bad faith lawsuits in federal and state courts and ADR proceedings involving rescission and application issues, regulatory exclusions, insured v. insured exclusions, notice issues, claims-made issues, prior and pending litigation issues, "no loss" issues, "other insurance" issues, dishonesty and personal property exclusions, interrelatedness issues, bodily injury exclusions and other coverage issues.

    Achieved summary judgment in precedent-setting coverage case on claims alleging excessive force and police brutality.
