Representative Experience
· Representation of debtors and unsecured creditors committees in bankruptcy litigation and receivers in receiverships to recover assets for creditors and investors
· Representation of investors and creditors in litigation relating to fraud, waste, and mismanagement by company insiders and representing fiduciaries facing similar claims
· Representation of investors in enforcement of drag-along rights and representing minority shareholders' rights in disputes between private equity investors and company management
· Representation of a Fortune 250 energy company in litigation relating to tax credits for synthetic fuel production through trial
· Representation of a real estate hedge fund through trial to recover property for portfolio
· Representation of a real estate investment trust to recover damages from breach of contract and breach of warranty
· Representation of developers in commercial and residential construction litigation and third-party practice against contractors, subcontractors and suppliers
· Representation of trademark holders against infringers in domain name, trade name and trademark litigation in state courts and before the Trademark Trial and Appeals Board and the UDRP
· Representation of a holder of telephony patents in litigation against former licensees
· Representation of a majority investor in complex legal malpractice litigation against former counsel which represented both the public company and the majority investor in debt-financing transactions
· Representation of an international parcel tanker corporation in litigation arising out of government civil and criminal antitrust investigations
· Significant experience counseling and advising businesses on electronic records management and has drafted marketing and joint-development agreements for technology companies
