In addition to Mr. McGrann's work in environmental law, he focuses on commercial litigation and antitrust matters. His three decades of experience include cases in commercial contracts; hostile corporate takeover litigation; directors' and officers' liability; a wide range of governmental and private-party environmental litigation; and toxic tort defense throughout the United States. He has extensive experience representing both defense and prosecution.
Areas of Experience
Environmental Practice
Mr. McGrann defended a major corporation against environmental claims at more than 50 sites and dealt with environmental agencies on issues resulting from manufacturing processes from the 1950s. He also prosecuted a lawsuit for a Fortune 100 company to enforce coverage for environmental liabilities under specialized forms of environmental insurance. In addition, Mr. McGrann has both brought and defended multi-million dollar cost recovery actions under both CERCLA and state environmental statutes.
Other Representations
Significant cases handled by Mr. McGrann include:
· the successful defense of the sale of a corporate subsidiary through a leveraged buyout against charges of a fraudulent conveyance;
· prosecution of an engineering malpractice case regarding negligent design of manufacturing equipment;
· defense of a savings and loan in litigation stemming from a proxy fight;
· defense of a company in a 12,000-plaintiff toxic tort suit;
· negotiation and litigation of oil and gas lease matters; and
· litigation of environmental indemnity claims.
