Jerry Gallagher is a partner in the South Bend, Indiana office of Barnes & Thornburg LLP, where he is a member of the firm's Intellectual Property Department. Mr. Gallagher is registered to practice before the U.S. Patent and Trademark Office and concentrates his practice in obtaining, exploiting and enforcing patent and trademark rights in a variety of technology fields, including the recreational vehicle, medical device and steel industries. In addition to preparing and prosecuting patent and trademark applications, Mr. Gallagher counsels clients with respect to international patent protection, patent licensing and other portfolio management issues. He advises clients on infringement and validity issues, including designing around competitors' patents, and renders opinions of counsel on these issues. His practice includes representation of clients in intellectual property litigation in federal district court and the U.S Court of Appeals for the Federal Circuit. Mr. Gallagher also represents clients in trademark matters, including clearing and registering marks, licensing, portfolio management and international trademark enforcement and anti-counterfeiting matters. He has represented numerous clients in trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board. Mr. Gallagher received his B.S. in metallurgical engineering in 1989 from the University of Notre Dame. He earned his J.D. cum laude in 1992 from the University of Notre Dame Law School, where he was lead articles editor of the Notre Dame Law Review. Mr. Gallagher is a member of the St. Joseph County and Indiana State Bar Associations. He serves on the board of the American Red Cross, St. Joseph County Chapter since 1998 and served as chairman of the board from 2003-2004. He is admitted to practice in the state of Indiana, before the U.S. Patent and Trademark Office, before the U.S. Courts of Appeals for the Seventh and Federal Circuits, and before the U.S. District Courts for the Northern and Southern Districts of Indiana.
