Biography

Glennon handles company-critical litigation and provides strategic advice to in-house counsel and senior management in crisis management, credit transactions, regulatory compliance, product safety, litigation avoidance and other issues. As a result, he has a breadth of knowledge and experience not often found with other trial attorneys.

Glennon's two decades in the practice of law involves an ever-widening range of technologies, products and services, including consumer products, financial services, industrial equipment, marketing technology, pharmaceuticals and telecommunications. He frequently works with manufacturing and technology companies, as well as financial institutions and other clients. As a persuasive litigator on the firm's Technology, Manufacturing & Transportation and Financial Services teams, Glennon has delivered winning arguments in state and federal courts at the trial and appellate levels, as well as in arbitration and bankruptcy proceedings and before administrative agencies.

Clients seek his advice in commercial disputes, class action lawsuits, product liability defense, contractual claims, intellectual property, licensing and regulatory compliance. He also assists clients with internal investigations and counsels companies regarding efforts to protect intellectual property, reduce litigation, comply with regulatory requirements and respond to inquiries from government agencies, including the Department of Justice, state attorneys general, as well as federal and state agencies. Glennon also advises senior management regarding branding initiatives and corporate governance. He handles cases as lead counsel but also collaborates as part of national trial teams in conjunction with other top U.S. law firms.

Glennon's class action experience includes state and federal proceedings involving regulatory matters, advertising, marketing and billing practices, as well as numerous lawsuits filed under the Telephone Consumer Protection Act (TCPA), Missouri Merchandising Practices Act (MMPA), the Fair and Accurate Credit Transactions Act (FACTA), and state deceptive trade practice statutes. Glennon's experience extends to shareholder litigation, including securities fraud, derivative actions and fiduciary duty claims against officers and directors. He has worked with lawyers across the country in a variety of multiple-firm cooperative approaches on behalf of clients, including the consolidation of more than 30 cases challenging a client's advertising and billing practices and the use of an All Writs Act injunction enjoining several competing state cases.

Glennon's work often involves state and federal regulations, as well as industry and consensus standards of the American National Standards Institute (ANSI), Underwriters Laboratories (UL), the National Fire Protection Association (NFPA) and many others. He has significant experience with investigations and lawsuits relating to fires, explosions and workplace fatalities. Glennon also assists clients with safety investigations, product recalls and other corrective actions. He advises clients regarding reporting requirements, submissions and complaint responses related to the Consumer Product Safety Commission (CPSC). He frequently works with product safety officers, engineers and outside consultants.

His experience includes advertising and marketing practices, credit transactions, patented biotechnology, counterfeit goods, process control systems, fiber optic cables, plastics and injection molding equipment, remote control systems, wireless telephones, steam conditioning valves, emission controls, signal integrity products, batteries, motors, rotors and other motor components, pump systems, electrical switches, cryogenic products, control valves, water heater controls, appliance controls, ladders, manufactured housing, hot tubs, lighting fixtures, socket assemblies, heat tape, tires, tools, natural gas, LP gas and odorant.

In the construction field, Glennon has handled contract default, supply/procurement, defective workmanship, delay, engineering and design defect, and mechanics' lien/bond claims. His experience involves a variety of commercial, industrial and municipal projects, including one of the nation's largest cement plants, a cogeneration power plant, one of the country's largest mass transit systems and fiber optic cable relocation.

Before returning to private practice, Glennon was unit chief of the Consumer Protection Division of the Missouri Attorney General's St. Louis office, where he directed the investigation and prosecution of violations of Missouri's securities, antitrust and consumer fraud statutes. He handled a broad array of issues, including electronic commerce, advertising, promotion and marketing, truth-in-lending (TILA), counterfeit goods and automobile leasing, as well as health and safety claims. He also represented Missouri in a variety of multistate investigations coordinated by the National Association of Attorneys General (NAAG) and in joint state/federal investigations with representatives of the Federal Trade Commission (FTC) and other state and federal agencies.

Experience
•Obtained summary judgments and/or dismissals for a variety of clients, including manufacturing and technology companies and service providers, in more than two dozen cases with no settlement payment.
•Secured the dismissal of three nationwide putative class action cases without any settlement payment.
•Recovered more than $3.1 million for creditor, notwithstanding the filing of three separate bankruptcies, two by judgment debtors and a third by a partner in one of the debtors.
•Obtained an order compelling the imaging and inspection of a plaintiff's computers and electronic storage devices, requiring plaintiff to answer expedited discovery and providing other relief, all in advance of the Rule 16 Scheduling Conference and/or the issuance of a case management order. The order also dismissed 20 counts filed against the client and all claims against the client's president.
