Graham Nesbitt is counsel in our Litigation Group in Montréal.
His practice focuses on civil litigation. His areas of practice include international arbitration, class actions, directors' liability, insurance, libel and slander, mergers and acquisitions, municipal law and product liability. He is a governing member of the Fondation du Barreau du Québec.
He has appeared in many cases before the Supreme Court of Canada, including:
· Québec North Shore Paper Company and Québec and Ontario Transportation Company Limited v. Canadian Pacific Limited and Incan Ships Limited - Constitutional law: jurisdiction of the Federal Court of Canada over railways and maritime matters;
· Incan Ships Limited v. Canadian Pacific Limited - Maritime law: rights under arrest of a ship;
· The Royal Bank of Canada v. Concrete Column Clamps (1961) Ltd. - Liability for forged endorsements;
· Attorney General of the Province of Québec v. Dame Diane Mary Glassco and Archibald Cumming - Constitutional law: jurisdiction over divorce;
· Provincial Refining Company Limited and Newfoundland Refining Company Limited v. Atlantic Trading (Delaware) Corporation - Bankruptcy issues concerning the Come-by-Chance refinery in Newfoundland;
· Shell Canada Limited v. United Oil Workers of Canada, Local 1 and United Oil Workers of Canada, Local 2 and Claude Lauzon - Labour law: illegal strikes and arbitration;
· Canadian Johns-Manville v. Canadian Indemnity - Insurance law: obligations of the parties to disclose and inquire in the formation and performance of the contract.
He has received the following academic awards: Governor General's Gold Medal for the highest standing in the province for senior matriculation; First Class Honours in English and History (BA), Shakespeare Gold Medal in English, Lieutenant Governor's Gold Medal in History; First Class Honours in Law (BCL), University Scholar, the I.M.E. Prize in Commercial Law; Greenshields Memorial Scholarship; and Moyse Travelling Fellowship.
Mr. Nesbitt received his bachelor of arts (BA) from McGill University in 1958, his master of Arts (MA) from Oxford University (Balliol), and his bachelor of civil law (LLB) from McGill University in 1964. He was called to the Québec bar in 1964.
