Biography

Greg Gilchrist focuses his practice on intellectual property and antitrust litigation. He regularly advises clients on matters involving brand protection and product distribution and has handled a wide variety of commercial and business tort disputes. His extensive experience in pre-litigation counseling includes serving on a number of client policy committees and training teams.

Prior to joining the firm, Mr. Gilchrist was a founding shareholder at a California-based law firm. He has successfully represented a wide range of clients, including small scale to Fortune 500 companies in litigation and trials before state and federal courts. Levi Strauss & Co. Providing counsel about distribution policies, Internet policies, trademark and copyright policies and education for sales and marketing forces. Representing company in many trademark enforcement efforts and lawsuits and has successfully defended in several dealer termination suits.

Levi Strauss & Co. v. Abercrombie & Fitch. Representing Levi Strauss in trial and appeal against competitor regarding allegedly infringing stitching design.

Does v. Gap, et al. Defended apparel manufacturer against purported billion dollar class action claims of RICO and Alien Tort Statute violations relating to employment conditions.

Levi Strauss & Co. v. Evisu. Represented Levi Strauss against Japanese jeans maker for using allegedly infringing marks on replicas of iconic jeans styles.

Levi Strauss & Co. v. Vivat Holdings. Opposed trademark applications of rival jeans manufacturer, outcome of trial reported at 2000 TTAB LEXIS 817 (TTAB 2000).

Williams-Sonoma, Inc. Providing counsel about brand and copyright protection strategies; protection of IP assets on-line, distribution strategies, representing company in many enforcement and commercial lawsuits.

Williams-Sonoma, Inc. v. Estyle, Inc. Represented WSI in trade dress infringement action against competitor based on similarities in store design.

Williams-Sonoma, Inc. v. Target Inc. Represented WSI against Target in alleged copyright infringement and unfair competition action.

Madeline Weinrib v. Williams-Sonoma, Inc. Represented WSI in defense of alleged copyright infringements.

Hershey v. Williams-Sonoma, Inc. Represented WSI in defense of alleged trade dress infringements.

Commonwealth Scientific & Industrial Research Organisation. Representing Australian governmental research organization in patent infringement litigation regarding patents for wireless LAN technology.

CSIRO v. Intel, Microsoft, Dell, H-P et al. Represented CSIRO in patent infringement trial that settled pre-verdict.

CSIRO v. Marvell Semiconductor Inc. Represented CSIRO in patent infringement action.

Tyco Electronics Corporation. Counseling and litigation on behalf of Tyco in product liability and product distribution matters.

Unit Process Co. v. Tyco Flow Control. Representing manufacturer in state and federal trial and appeal courts in defense of state and federal exclusive dealing, tying, monopoly, trade libel and franchise law claims brought by competitors and terminated distributors.

All Alaskan Seafoods v. Raychem Corporation. Represented Tyco in trial of product liability action involving claims in excess of $150 million arising from fire aboard salmon and crab processing vessel, defense verdict after four week jury trial affirmed by Ninth Circuit.

Fisherman's Wharf Bay Cruise Corporation v. Blue & Gold Fleet. Representing plaintiff in predatory pricing, tying, price and services discrimination claims against rival provider of San Francisco Bay Cruises. Favorable settlement at trial after successful appeal reported at 114 Cal. App. 4th 309 (2003).

Blue Marlin Corp. v. VF Jeanswear. Represented plaintiff in trademark infringement action. Resulted in a favorable confidential settlement after preliminary injunction obtained.

TLM Tech, Inc. v. XO Communications, Inc. Represented Internet based company in infringement case against XO Communications. Resulted in a favorable, confidential settlement.

E-fax Communications, Inc. v. eFax.com. Represented electronic facsimile service provider in trademark infringement action against eFax.com. Resulted in a confidential, favorable settlement.

Solectron v. Netro. Represented customer in $20 million dispute with contract manufacturer related to excess inventory. Resulted in a favorable settlement.

Saratoga Fishing v. J.M. Martinac. Represented National Association of Manufacturers as amicus curiae in U.S. Supreme Court.
