The Land Use practice group at Gunster Yoakley provides comprehensive legal counsel to clients navigating through the broad range of issues that arise out of a complicated and always changing matrix of local, state and federal land use and environmental regulations. Florida has an elaborate permitting system which often requires local, regional and state approvals before development permits can be issued. Overlaying the state system is the complex federal regulatory scheme. Gunster Yoakley's Land Use attorneys have extensive backgrounds in representation before government agencies and in judicial and administrative litigation. Representative Matters

  • More than two decades of counsel to Arvida during development of Weston, one of the country's most successful planned communities. The scope of representation includes obtaining the original development order, rezoning and land use plan amendments, establishing local government controls and forming/administering the developer's numerous entities.
  • Created the current Planned Urban Development (PUD) plan for a 140 acre project located on the island of Palm Beach. Obtained approvals for 580 residential units, a hotel, golf course, club program, restaurants and retail. Handled condominium documents, unit sales agreements, club program documents and ocean coastal issues relating to approximately one mile of oceanfront property.
