Biography

Harvey is a member of Husch Blackwell's Healthcare, Life Sciences & Pharmaceuticals team and a recognized authority in healthcare law (including long-term care and white collar criminal defense), insurance regulation and regulatory and administrative law. Harvey has briefed and/or argued more than 100 appeals in appellate courts, including the U.S. Supreme Court, the U.S. Court of Appeals for the Eighth Circuit and the Missouri Supreme Court and Court of Appeals.

Harvey's industry experience includes:

•Assisting a nursing services company to receive approval from the Missouri Health Facilities Review Committee to move forward on a $35.7 million senior housing project in the St. Louis, Mo., area.

Representing one of Missouri's largest health maintenance organizations, and obtaining the dismissal of a lawsuit challenging the award of the largest contract in the history of the State of Missouri - the state Medicaid managed-care contract, worth more than $1 billion annually.

Defending an owner and operator of an adult day-care center in a pro bono matter whereby owner was facing a loss of more than $500,000 in a dispute with the Missouri Department of Social Services and the Missouri Department of Health and Senior Services. Represented center owner at the appeals level; court ruled in client's favor.

Harvey has authored many publications on long-term care, administrative law and consumer law and has presented programs on health reform, professional ethics, long-term care, fraud, abuse and compliance and other health law topics at national and regional seminars for the American Health Lawyers Association (AHLA), American Health Care Association, Missouri Health Care Association, Missouri Dental Association, Missouri State Medical Association, the Missouri Bar and the National Association of District Attorneys. He has also authored papers on election law and spoken at national programs on this subject.

Harvey served as an assistant attorney general under John Danforth from 1971 to 1977, where he was chief counsel of the Consumer Protection and Anti-Trust Divisions.

Experience

•Represented one of Missouri's largest health maintenance organizations and obtained dismissal of a lawsuit challenging the award of the largest contract in the history of the State of Missouri - the state Medicaid managed-care contract, worth more than $1 billion annually. A competing bidder had challenged the contract award in circuit court. Prevailed in an evidentiary hearing opposing a motion for preliminary injunction and obtained a judgment dismissing the case.

•In a pro bono matter, defended an owner and operator of an adult day-care center facing a loss of more than $500,000 in a dispute with the Missouri Department of Social Services and the Missouri Department of Health and Senior Services. Represented the adult day-care center owner at the appeals level, and the appeals court ruled in client's favor and upheld the prior conclusions determined by the Administrative Hearing Commission.
