The Real Property Tax & Condemnation practice group is preeminent in successfully litigating complex condemnation and tax reduction cases for all of our industrial, utility and commercial clients. The firm's experience in litigating and negotiating these cases spans many decades and covers all forms of real property valuation, including special franchises, electric generating facilities, industrial facilities, mining operations, and environmentally-damaged properties. The practice has been on the cutting edge of case law development involving condemnation procedure, real property tax procedure and valuation.
Hiscock & Barclay is at the forefront of creative resolution of real property tax burdens, which often involves complex negotiations with various levels of municipal government and issues of project finance, economic development programs and frequent interaction with industrial development agencies throughout New York State as well as many others. We regularly negotiate and craft settlement agreements, which are proactive and meet the needs of our business clients as well as the communities in which they operate. We also have extensive experience in and can assist the taxpayer in obtaining tax exemptions, in determining intangible valuation and functional and economic obsolescence at industrial facilities.
The firm's attorneys are intimately familiar with the equalization process administered by various states, as well as the "advisory appraisal" program which assists municipalities in assessing many of our clients' properties. Our attorneys have ongoing interaction with both state and local assessors and are intimately familiar with the assessment process.
