Biography

Howard is an IP trial lawyer who has successfully led litigation teams in a variety of patent infringement and other IP matters throughout the country. He has litigated matters on behalf of clients in the medical device, financial, telecommunications, semiconductor, and software industries.

Howard has successfully served as both first chair and co-counsel in patent litigation trials and has successfully argued numerous Markman hearings and summary judgment motions. He has also appeared before the International Trade Commission and coordinated multinational patent litigation in a variety of matters.

Howard also assists clients in litigation avoidance, including patent clearance studies, license negotiations, and strategic patent counseling. His experience in interferences, reexamination procedure, and the coordination of foreign patent actions provides additional roads to success in major patent disputes.

Howard has spoken extensively, both domestically and abroad, on a range of IP topics, including the Supreme Court s Bilski decision.

Reported CasesRepresentative Matters: Co-lead trial counsel for Ambato Media, LLC in its patent infringement jury trial victory over Garmin International, Inc. in the Eastern District of Texas; Obtained the first summary judgment of invalidity in a client's favor under the US Supreme Court's KSR v. Teleflex decision; Lead trial counsel for a foreign television company in its $8.3 million jury verdict of copyright and trademark damages in the Central District of California; Lead trial counsel for one of the world's largest banks in its arbitration victory defeating a $50 million software license and trade secret claim (three-week arbitration in Minnesota); and, for that same client, successfully defending and settling the largest bank-related patent litigation in US history; Lead trial counsel for the inventor of the world's first FDA-approved multifocal intra-ocular lens in patent license dispute with a major lens manufacturer in the Central District of California (case successfully resolved on the eve of trial after court made significant pretrial rulings in our client's favor)
