Practice/Industry Group Overview

Jackson Walker's Regulatory and Legislative section is comprised of attorneys with expertise serving clients in diverse industries such as agriculture, energy, financial institutions, health care, insurance, and public utilities. These attorneys have significant experience representing clients in front of state and federal agencies and the Texas State Legislature regarding regulatory compliance, development of new legislation, and responses to enforcement actions. Strong advocates of the "ounce of prevention" philosophy, Jackson Walker's regulatory and legislative attorneys regularly advise clients on fulfilling their responsibilities in relation to relevant statutes and policies to avoid time-consuming and potentially costly enforcement proceedings. Jackson Walker acquired significant governmental affairs experience when the law firm of Small, Craig & Werkenthin joined with Jackson Walker in January 1999. The attorneys of Small, Craig & Werkenthin have a long history of involvement with Texas government and politics. Now, Jackson Walker L.L.P. has the experience and first-hand knowledge to deal with tough legislative and regulatory problems in Austin.

This experience includes the representation of clients before the Texas Legislature on issues important to the business community. The firm's involvement in Texas politics began in the 1930's with C.C. Small, Sr., who served as a State Senator from Amarillo for many years. Richard C. Craig served in the Texas House as a Representative from the Panhandle in the early 1940's. Later, Charles F. Herring served for many years as the State Senator from Austin. C.C. Small, Jr., served as General Counsel of the Texas Savings and Loan League for over 35 years and in that capacity played a leading role in drafting and passing legislation dealing with important issues for financial institutions.

As state government has continued to grow, and the number of state regulatory agencies has proliferated, the firm's representation of clients on legislative and state regulatory matters has also grown. The individuals in the firm who regularly deal with legislative and regulatory matters have been organized into the Governmental Affairs section and represent over 70 years of experience in this area. Attorneys in the firm's Administrative Law section also work closely with the section on administrative proceedings before the various regulatory agencies.

  • Petroleum Storage Tanks - Administrative proceedings and consultation concerning potential liabilities arising from ownership or operation of underground petroleum storage tanks, including representation before the TNRCC concerning liability as owners or operators of leaking underground storage tanks and reimbursement for assessment and remediation costs from the Texas Petroleum Storage Tank Remediation Fund
  • Solid Waste Disposal - Administrative proceedings and consultation concerning solid waste disposal operations, including representation of clients before the TNRCC in support of, or opposition to, municipal landfills, medical waste disposal facilities, and other regulated waste disposal activities, and assistance in securing funding for solid waste disposal facilities (including evaluation of requests for Texas Water Development Board financing assistance)

  • Wastewater Discharge Permit - Representation in defense of challenges to wastewater permit amendment on jurisdictional grounds, securing TNRCC staff support for aggressive action in pursuing successful issuance of wastewater permit amendment under high profile circumstances
  • Wastewater Discharge Permit Protest - Negotiated an alternate discharge route for a landowner who would have been adversely affected by a proposed wastewater discharge permit
  • Endangered Species Regulation - Representation in negotiations with U.S. Fish & Wildlife Department concerning potential endangered species modification and actions necessary to avoid need for an incidental take permit
