James (Jay) F. Glunt's practice involves a wide variety of labor and employment issues. Most importantly, this includes helping clients avoid litigation through counseling regarding policies and procedures, work/family balance issues and government regulations. Jay also handles employment litigation in state and federal courts and before administrative agencies. Jay's litigation and counseling experience extends beyond the labor and employment realm, to matters involving construction and land use planning. In fact, he served for 10 years as a member of the Dormont (PA) Zoning Hearing Board and he serves on the board of the civic organization Sustainable Pittsburgh. Jay regularly assists on transactional matters by drafting construction industry forms and agreements (construction contracts, lien waivers, design professional agreements, development contracts, and the like) and employment forms and agreements (employment contracts, handbooks, executive compensation plans, severance plans, release agreements and restrictive covenants). Jay is vice chair of the firm's working group on matters relating to electronically stored information, and regularly advises clients regarding the pre-litigation duty to preserve ESI. At Buchanan, Jay was a co-coordinator for the 2005 and 2006 Summer Associate Programs in Pittsburgh, which were ranked by The American Lawyer as #1 in Pittsburgh and #2 and #11 (respectively) in the nation. Jay serves on the firm's recruiting committee for the Pittsburgh office. Jay was recognized in Philadelphia Magazine as a member of the Pennsylvania Super Lawyers® Rising Star list for four consecutive years (2005 through 2008). Jay represented employers in the following recent employment discrimination litigation matters: · Defending a national employer in class and collective action claims pursued by former employees. · Representing a major retail store in employment discrimination charges brought in the federal and state administrative agencies in various jurisdictions where the client does business. · Defending an international manufacturing firm in drug testing litigation, including a victorious argument before the Pennsylvania Superior Court to affirm a successful result in the lower court. Jay represented employers or executives in the following recent executive compensation and contract disputes: · Counseling a Pittsburgh software developing firm regarding its rights under restrictive covenants with former executive employees, and negotiating an efficient resolution. · Enforcing the compensation rights of a senior executive formerly employed by a Pittsburgh electrical product distribution company, at the same time as defending against the company's aggressive pursuit of adverse litigation, and ultimately negotiating an amicable resolution. · Defending an Ohio health care executive in covenant not to compete litigation, including a victorious argument before the Sixth Circuit to affirm a successful result in the lower court. Jay represented owners or contractors in the following recent construction industry negotiations and disputes: · Representing the Sports & Exhibition Authority of Pittsburgh and Allegheny County in construction contract negotiations, disputes and litigation arising under the new $330 million David L. Lawrence Convention Center. · Representing a contractor seeking recovery of unpaid billings through mechanics' lien litigation. · Counseling a major university in the formation and structure of construction, construction management and professional services contracts for new construction and renovation projects. While in law school, Jay served as a judicial intern with the Honorable R. Stanton Wettick, Jr. of the Allegheny County Court of Common Pleas, and with the Honorable Timothy K. Lewis, former Judge of the United States Court of Appeals for the Third Circuit. He competed in trial and appellate moot court competitions and served as editor-in-chief of Volume 38 of the Duquesne Law Review. Prior to attending law school, Jay was an intern architect with one of Pittsburgh's largest architecture firms. In that role, he assisted with the design and construction administration of building projects ranging in scope from $100,000 to $100 million.
