James Fallows Tierney is a litigation associate in the Washington office and a member of the firm's Supreme Court and Appellate practice group. His practice focuses on representing businesses, organizations, and individuals in critical motions practice in class actions and complex litigation, as well as before the Supreme Court and in federal and state appellate proceedings. He also assists businesses and organizations in achieving their policy and regulatory goals. While at the firm, he has developed experience in a range of substantive areas, with particular emphasis on consumer class actions, federal arbitration law, personal jurisdiction, and constitutional law.
In his appellate practice, James was recently the principal author of an amicus brief joined by 76 historians (including five Pulitzer Prize winners) urging the Supreme Court to reaffirm that the Fourteenth Amendment precludes states from imposing special burdens on minority groups' abilities to access the political process. He has received a number of awards for his legal writing, including the University of Chicago Law School's Joseph Henry Beale prize for highest distinction in research and writing.
Prior to joining the firm, James clerked for the Honorable Mary Schroeder, US Court of Appeals for the Ninth Circuit. He graduated with honors from the University of Chicago Law School, where he was the Executive Articles and Book Reviews Editor of the University of Chicago Law Review. While in law school, he interned with the Massachusetts appellate public defender, led the law school chapter of the American Civil Liberties Union, and was teaching assistant for Justice Albie Sachs of the Constitutional Court of South Africa.
