Biography

James Fallows Tierney is a litigation associate in the Washington DC office and a member of the firm's Supreme Court and Appellate practice group. His practice focuses on representing businesses, organizations and individuals in critical motions practice in class actions and complex litigation. His experience has spanned a range of substantive areas, including consumer class actions, federal arbitration law, personal jurisdiction and federal preemption. In addition to representing clients after disputes arise, he counsels and assists clients in reducing their exposure to disputes, including through achieving their legislative and regulatory goals.

In his appellate practice, James has drafted over a dozen briefs before the Supreme Court and in federal and state appellate proceedings. He was recently a principal drafter of an amicus brief on behalf of Americans United for Separation of Church and State explaining why the Establishment Clause limits statutory religious accommodations that impose burdens on third parties.

Prior to joining Mayer Brown, James clerked for the Honorable Mary Schroeder, US Court of Appeals for the Ninth Circuit. At the University of Chicago Law School, he served as Executive Articles and Book Reviews Editor of the University of Chicago Law Review, received the Joseph Henry Beale Prize for highest distinction in legal research and writing and interned for the Massachusetts appellate public defender’s office. James serves as an Associate Trustee for the Washington Lawyers’ Committee for Civil Rights and Urban Affairs.
