Jim Seaman concentrates his practice in the area of labor and employment law litigation and counseling. Prior to joining the firm in 1990, he worked for over 20 years with Fortune 500 companies in various human resource management positions.
Representative Matters
· Represents and defends employers in cases involving claims of employment discrimination, wrongful discharge, breach of employment contracts, minimum wage and overtime pay violations, and a variety of employment-related torts, as well as in restrictive covenant and trade secret misappropriation litigation;
· With an eye toward maintaining best business practices and preventing discrimination claims, which can lead to costly litigation, advises employers on a wide array of matters including employee hiring, counseling and discipline practices, wage and hour issues, prevailing wage questions, independent contractor status, restrictive covenants, and contract employees (including leased employees);
· Advises employers on OSHA compliance matters, and defends employers in proceedings arising out of claims of OSHA violations;
· Advises employers on labor contract interpretation and plant closing issues, and defends employers in labor arbitration proceedings and in matters before state and federal labor boards.
· Defends employers in administrative proceedings against claims under workers' compensation and unemployment compensation laws;
· Drafts and reviews employment policies and handbooks, employment contracts, and separation agreements;
· Performs compliance reviews of employment policies and practices;
· Has served as Special Counsel for a number of municipal governments to investigate and advise on discrete issues.
