Jim Wertheim is a member of the firm and works out of the Cleveland office with a focus on consumer financial services litigation. He is a trial lawyer with over 25 years experience representing clients in state and federal courts. He has tried over 80 matters to juries and courts. He has also represented clients in injunction proceedings and regulatory matters. Jim has represented clients in many class action matters and won the only favorable court decision allowing removal by a class action counterclaim defendant. Jim is the leader of the firms litigation practice in both Cleveland and Albany.
Litigation
Jim is recognized for his work in the field of consumer financial services and business litigation, representing clients in lawsuits across the country. He has defended many class actions and individual lawsuits involving numerous causes of action and emerging theories, including claims relating to alleged predatory lending, mortgage yield spread premiums, mortgage related fees, nonjudicial foreclosures, standing, credit insurance, repossessions, mortgage escrow practices, debt collection practices, and causes of action arising under the TILA, HOEPA, FDCPA, FCRA, RESPA, RICO and state UDAP laws.
