Jason Herbert is a litigation partner and Co-Chair of the Professional Governance & Regulation practice group in the Vancouver office of Davis LLP, where he has practised regulatory and administrative law and advocacy and dispute resolution since completing his articles with the firm in 1999.
Mr. Herbert's practice includes professional governance and regulation, health, education, privacy law compliance, human rights, executive employment, energy and utilities, and aboriginal law.
Mr. Herbert has a particular focus on administrative (public) law. He has extensive experience advising professional regulatory clients on governance, professional conduct review and discipline, registration, bylaw and policy development, public policy advocacy, regulatory compliance, human rights, labour mobility, access to information and privacy, and risk management. He also regularly advises and acts for a wide range of other clients in or dealing with the public sector, including educational institutions, energy companies, and First Nations.
Mr. Herbert has appeared as litigation counsel in proceedings before the British Columbia Supreme Court, the British Columbia Court of Appeal, and the Federal Court of Canada, and before various administrative tribunals, including the Office of the Information and Privacy Commissioner of British Columbia, the British Columbia Utilities Commission and the Yukon Utilities Board. In 2010, Mr. Herbert acted in several of the first hearings before the newly established BC Health Professions Review Board, and he continues to practise frequently before that tribunal. Mr. Herbert has also participated in and designed alternate dispute resolution processes, including arbitration and mediation.
Mr. Herbert was the Silver Medallist in the 1997 graduating class at the University of Toronto Law School, and was called to the British Columbia Bar in 1999 after completing a one-year clerkship with the Supreme Court of British Columbia, with Madam Justice Saunders as his principal. He was also the Governor General's Medallist for the University of British Columbia Faculty of Arts in 1992, and completed a Masters degree in mathematics at the University of Toronto in 1994. Since 2009, Mr. Herbert has also been a member of the Yukon Bar.
Mr. Herbert has been Chair of the Student Recruitment Committee for Davis's Vancouver office since 2008.
