    Jeff represents corporate debtors, indenture trustees, secured lenders and official court-appointed committees and trustees in large Chapter 11 reorganization cases, Chapter 7 liquidation cases and out-of-court restructurings. Jeff's practice also includes representation of banks, indenture trustees and commercial and residential mortgage lenders in all types of litigation.

    Bankruptcy Related Matters

    In re Ran Oil Company, represented indenture trustee holding secured claims against convenience store gas stations in Chapter 7 case pending in Erie, Pennsylvania.

    In re Colorado Lubrication, represented indenture trustee holding secured claims against Jiffy Lube franchisee in Chapter 11 bankruptcy case pending in Denver Colorado.

    In re United Companies Financial Corporation, represented the Official Committee of Equity Security Holders of a multi-billion dollar sub-prime conduit lender in Chapter 11 bankruptcy case pending in Wilmington, Delaware.

    In re Gulf Properties, Inc., represented construction lender in recovery of claims in Chapter 11 bankruptcy of real estate investment company.

    In re Flexel, Inc., represented debtor cellophane manufacturer in Chapter 11 Bankruptcy case through consummation of liquidating plan of reorganization that encompassed sale of substantially all of the company's assets to a European conglomerate.

    In re Sewell Manufacturing Company, Inc., represented men's clothing manufacturer as debtor in Chapter 11 case through consummation of a confirmed plan of reorganization. Case required distress termination of defined benefit pension plan and resulted in sale of substantially all of company's assets.

    In re Shell Corporation, represented largest secured lender in single asset Chapter 11 case involving medical office building. Case resulted in a consensual plan of reorganization which ultimately permitted the lender to foreclose on its collateral.

    In re One Atlanta Plaza Associates, represented debtor in single asset Chapter 11 bankruptcy involving high rise office building in Atlanta, Georgia through consummation of a consensual plan of reorganization.

    In re Aiden Emmet Barnes, III, represented individual debtor in Chapter 11 case involving in excess of $72 million in scheduled assets and in excess of $50 million in scheduled debts, over 30 secured creditor classes, and a substantial real property portfolio consisting of assets in Georgia, Florida and South Carolina.

    General Litigation Matters

    The Gordon Bank v. Homeowners Financial Services, Inc., et al., represented lender in pursuit of fraud claims against a mortgage broker and related entities resulting from misappropriation of construction loan proceeds in a residential construction project.

    Linda Brown v. Taylor, Bean & Whitaker Mortgage Corp., defended mortgage company against claims of wrongful foreclosure. Argued and obtained unanimous reversal of trial court judgment from Georgia Supreme Court.

    Helen Blanchard v. DeLoache-Powers-Blanchard et al., represented contingent legatees in federal interpleader action involving multi-million dollar estate, including prosecuting successful appeal before the United States Court of Appeals for the Eleventh Circuit.

    Robert Davis et al v. Taylor, Bean & Whitaker Mortgage Corp., defended company against breach of contract and statutory wage claims brought by former employees in federal district court in Pennsylvania.

    Polyfibron Technologies., Inc. v. The National Solvent Exchange Corp., defended corporation sued for trademark infringement, unfair competition and unfair business practices.

    Residential Lenders Beware: Eleventh Circuit Affirms Strip Off in Chapter 7 Bankruptcies

    The U.S. Court of Appeals for the Eleventh Circuit has ruled that Chapter 7 debtors can strip off, or void, wholly unsecured mortgage liens. The per curiam opinion, issued May 11, 2012, marks a significant departure from the standard Chapter 7 practice in most districts.
