Representative Experience
For the past twenty-five years Mr. Nix, a former construction engineer, has focused his practice entirely upon construction law representing stakeholders involved in every facet of the construction industry. Having worked in construction, Mr. Nix offers a fresh, unique and pragmatic approach to helping clients solve problems ranging from negotiating simple agreements to resolving large complex multiparty disputes.
Mr. Nix has represented clients in more than 95 separate multi-million dollar disputes, both prosecuting and defending claims with a cumulative value in excess of $3.8 billion dollars. His representations have been as diverse as the industry itself and include the design and construction of power plants, locks and dams, airports, chemical plants, tunnels, data centers, smart highways, colleges, treatment plants, factories, high rises, stadiums, museums, resorts, condominiums, shopping malls and institutional buildings throughout the America's and the Caribbean. He has participated in more than 230 formal dispute proceedings, including jury and bench trials, mini trials, international and domestic arbitrations, dispute review boards, administrative proceedings and mediations as well as multiple combinations of the above.
Mr. Nix has drafted and negotiated the entire array of documents necessary to support the planning, procurement, design and development of construction projects in the modern era. Throughout the years, he has been responsible for drafting more than 125 separate multi-million dollar design and/or construction contracts, based upon project delivery methods ranging form, EPC, design-build, CM at risk & GMP-fast track, finance-design-build-operate-maintain, as well as design-bid-build arrangements for Projects throughout the America's, Europe, and Asia. He has also drafted and negotiated hundreds of the ancillary documents required to ensure these delivery methods run smoothly, ranging from RFP's, project labor agreements, teaming arrangements, joint ventures, subcontracts, purchase orders, leases, easements, change orders along with a host of other related documents.
Mr. Nix routinely counsels clients upon issues of risk management and dispute avoidance throughout all stages of construction. He has been a pioneer in integrating modern tools into his unique approach towards problem solving, including the use of BIM, internet information systems, and real time dispute resolution.
Mr. Nix is an ardent supporter of the firm's pro-bono initiatives. He leads the Wills Project, drafting wills and other estate documents for individuals battling cancer, AIDS, MS, ALS as well as many other forms of debilitating illnesses. He has recently expanded the Wills Project to include the drafting of estate documents for service members and their spouses, including members of the military, police, fire, and EMT's. He also routinely represents veterans of the military services in seeking disability benefits for injuries or illnesses that are service related. Last but not least, he has assisted in the building of more than 50 Habitat for Humanity homes over the last 30 years.
Mr. Nix has taught classes upon construction law, including classes at the Georgia Institute of Technology, and frequently lectures and writes upon topics of current interest to the construction industry.
