Distinguished for his professional achievements as one of the state's "40 Under 40" by the New Jersey Law Journal, Mr. Testa represents debtors, creditors' committees, chapter 11 and chapter 7 trustees, litigation trustees, and creditors in complex bankruptcy proceedings and related litigation. Mr. Testa also actively litigates complex civil disputes on behalf of corporations, construction entities, and individuals in federal, state, and appellate courts. Additionally, Mr. Testa counsels clients with regard to licensing proceedings before the New Jersey Casino Control Commission and in internal white-collar corporate investigations.
Mr. Testa has served as debtors counsel to Trump Hotels & Casino Resorts Inc. in its two most recent Chapter 11 bankruptcy proceedings, currently serving as co-counsel in its confirmed plan of reorganization which involved a contested and competing chapter 11 plan hearing, and in 2004 which resulted in a confirmed plan of reorganization of over $2 billion of debt. He also served as co-counsel to the Official Committee of Unsecured Creditors of In re GB Holdings, Inc. a case relating to the former Sands Casino in Atlantic City, New Jersey wherein the creditors' committee terminated exclusivity of the debtor and won confirmation of a plan of reorganization.
Mr. Testa has significant experience serving as counsel to both Chapter 11 and Chapter 7 Bankruptcy Trustees in complex cases throughout the nation including: In re Solomon Dwek, a ponzi case in which the Chapter 11 trustee administers over 80 debtor entities which own more than 300 commercial, industrial and residential properties located throughout the United States, in which the Chapter 11 Trustee commenced hundreds of adversary proceedings, liquidated the real estate portfolio and gained confirmation of a Chapter 11 plan of liquidation; In re Pappas Broadcasting, Inc. in which the debtors and their non-debtor affiliates operated the largest privately held commercial television broadcast group in the United States as measured by Nielsen Media Research in which Mr. Testa represented the Trustee in the sale of numerous television stations, In re Student Finance Corp, a student loan company whose claims exceeded $1,1 billion; and in In re MUMA Services, Inc. a shipping, stevedoring and warehousing servicing company. Mr. Testa has also represented the liquidation trustee of Able Laboratories, a generic pharmaceutical company that filed for bankruptcy protection following an FDA recall.
Mr. Testa has experience both prosecuting and defending a wide range of bankruptcy-related litigation matters including fraudulent conveyances, preferences, Ponzi schemes, derivative employment issues, claims objections, fee auditor disputes, tax disputes, and counseling clients in both the purchase and sale of distressed assets, including real estate, loan portfolios, television stations and other assets.
Mr. Testa is subcommittee chairman of the New Jersey State Bar Association Bankruptcy-Young Lawyers Section and was named a New Jersey Rising Star for 2006-2010. In 2007, 2008, and 2010 Mr. Testa served as a panel speaker at the New Jersey State Bar Association Annual Meeting and Convention. Mr. Testa is also a member of the District VA Ethics Committee. He has been recognized as a Chambers USA "Leaders in their Field" lawyer for 2011 and 2012.
Mr. Testa has served as a volunteer to The Buoniconti Fund to Cure Paralysis, which is the National Fundraising Arm of the Miami Project to Cure Paralysis.
Mr. Testa has been recognized as a New Jersey Rising Star in 2011.
