Mr. Wegner, a partner, concentrates in the representation of creditors in bankruptcies. He has represented clients in bankruptcy courts in more than 47 jurisdictions in cases involving a wide range of transactions, including commercial real estate financings, asset-based lending and real estate and lease financings, and executory contracts. In addition, he has represented entities making acquisitions through bankruptcy proceedings as well as post-petition lenders. He is actively involved in structuring lending transactions through the use of bankruptcy-remote vehicles.
Mr. Wegner has served as president of the Nebraska State Bar Bankruptcy Section and is a frequent lecturer at professional education seminars. He is a contributing author to the Health Care Insolvency Manual published by the American Bankruptcy Institute.

The Second Circuit recently held, in a case of first impression, that a pre-bankruptcy payment by an issuer of commercial paper to redeem the commercial paper can constitute a protected settlement payment under the Bankruptcy Code that is not avoidable as a preference or as a constructively fraudulent transfer in a subsequent bankruptcy case of the issuer.
