| Biography | Jennifer Blum Feldman practices in the area of employment law with a focus on preventive counseling and compliance. In this capacity, Ms. Feldman advises employers regarding federal and state employment laws, including Title VII, FLSA, FMLA, ADA, ADEA, USERRA, WARN, state employment statutes and state wage payment laws; drafts policies that include employee handbooks, equal employment opportunity policies, wage and hour policies, paid time off policies, leave of absence policies and tuition reimbursement policies; drafts agreements, including employment agreements, separation agreements, independent contractor agreements, confidentiality agreements and noncompetition and nonsolicitation agreements; audits employment practices that include proper payment of exempt and non-exempt employees, classification of employees as exempt versus non-exempt and independent contractor designations; works with corporate attorneys on client acquisitions and sales, conducts employee-related due diligence and drafts employee provisions for asset and stock purchase agreements; prepares affirmative action plans, represents clients in OFCCP audits and advises clients regarding compliance with Executive Order 11246 and related obligations; investigates employee claims of harassment, discrimination and retaliation for employers; and defends employers in administrative proceedings before the EEOC, the DOL and similar state agencies. Ms. Feldman also provides training to in-house counsel, managers and other employees. She is a regular presenter on topics such as the FLSA, WARN, affirmative action, military leave and work-life balance. While Ms. Feldman focuses her practice on preventive counseling and compliance, she also has significant experience as a litigator, defending local, regional and national companies in both single-plaintiff and class action lawsuits. She has been involved in the litigation of all manner of discrimination and harassment claims as well as wage and hour claims, family leave claims and ERISA claims, among others. Ms. Feldman has been cited as an authority on employment law by a number of publications, including the Associated Press, Human Resources Executive Online and HR Magazine. Ms. Feldman is a 1998 cum laude graduate of Harvard Law School and a magna cum laude graduate of Cornell University. Following law school and before entry into the private practice of law, Ms. Feldman clerked for the Honorable Stanley S. Brotman, U.S. District Judge for the District of New Jersey.
