Biography

Jennifer Burdman is a counsel in the firm's Washington, D.C. office, where she practices in the Intellectual Property Group. Ms. Burdman's practice includes all aspects of patent law, with a particular focus on patent litigation. She has litigated infringement cases involving a variety of technologies, including avionics safety systems, commercial vehicle braking systems, medical devices, DNA labeling, pharmaceutical products (including ANDA Paragraph IV filings under the Hatch-Waxman Act), telecommunications, e-commerce, computer software, and image-processing systems. She is experienced in all aspects of intellectual property litigation, from pre-suit investigations and opinions through trial and appeal.

Ms. Burdman has also developed a great deal of expertise concerning e-discovery issues. In particular, she provides counseling to clients regarding the Federal Rules of Civil Procedure as they pertain to electronically stored information (ESI), records and information management, technology issues, and related ethical concerns. She counsels clients on litigation-readiness planning, including the development and application of effective document/data retention policies and "document hold" practices. She has considerable experience in designing and implementing protocols for the preservation, collection, review, and production of electronic information.

Ms. Burdman graduated from Dartmouth College with an A.B. in biochemistry and molecular biology and received her J.D. from Fordham University School of Law. She is admitted to the New York and District of Columbia bars, as well as the United States Court of Appeals for the Federal Circuit and the District Courts for the Southern and Eastern Districts of New York and the Eastern District of Michigan. Ms. Burdman is registered to practice before the United States Patent and Trademark Office.

Representative Cases

· E.I. du Pont de Nemours and Company v. Kolon Industries, Inc., et al., No. 3:09-cv-58 (E.D. Va.): Represented plaintiff DuPont in case alleging misappropriation of over 100 trade secrets relating to KEVLAR® fiber technology in one of the largest trade secret misappropriation cases in the United States. Obtained a $919 million verdict against Kolon for the theft of KEVLAR® technology after an eight-week jury trial held in Richmond, Virginia.

· Bendix Commercial Vehicle Systems et al. v. Haldex Brake Products, No. 1:09-CV-176 (N.D. Ohio). Representing plaintiffs in patent infringement action involving air disc brakes for commercial vehicles, securing jury verdict of willful infringement.

· Bendix Commercial Vehicle Systems et al. v. WABCO Automotive Control Systems, No. 1:09-CV-177 (N.D. Ohio). Representing plaintiffs in patent infringement action involving air disc brakes for commercial vehicles.

· Applera Corp. v. Wyeth, Inc. (Cir. Ct. Montgomery County). Represented plaintiff in a multi-million dollar licensing dispute pertaining to the licensing of proprietary human genome data and technology.

· Curtiss-Wright Flow Control Corporation v. Zimmermann & Jansen, et al. (C.D. Cal.). Represented patentee in infringement action involving industrial valves used to dehead coke drums during oil refining operations.

· Every Penny Counts v. First Data Corporation, et al. (M.D. Fla.). Represented defendant in multi-defendant patent litigation involving pre-paid gift cards.

· Goss International Americas, Inc. v. MAN Roland Inc., et al. (D. N.H.). Defended printing press manufacturer in patent infringement litigation.

· Morris Reese v. AT&T, et al. (E.D. Tex.). Represented defendant in multi-defendant patent litigation involving telephony systems.

· Pharmaceutical Solutions v. Vitamax RX, et al. (D. Minn.). Represented patentee in infringement action involving veterinary pharmaceuticals.

· Symbility Solutions Inc. v. Xactware, Inc. (E.D. Mich.). Represented patentee in declaratory judgment action involving patents, copyrights and trademarks for graphical modeling system used to develop insurance claim estimates, securing favorable settlement.

· Wilco AG v. Packaging Technologies & Inspection LLC (D. Del.). Represented patentee in infringement action involving package leak testing technology.
