Ms. Weaver is a partner at Waller Lansden, and she focuses her practice on healthcare litigation, primarily False Claims Act/qui tam litigation, government and internal investigations, corporate compliance issues and securities fraud litigation. Recently, Ms. Weaver obtained a summary judgment dismissal of a False Claims Act case asserting Medicaid fraud against a behavioral healthcare company. She also has secured a pre-trial dismissal of a False Claims Act case asserting Medicare billing fraud. In addition, Ms. Weaver has represented healthcare companies in connection with federal and state government investigations, internal investigations, physician disputes and commercial litigation.
Ms. Weaver has represented a Fortune 500 pharmaceutical services company in several class action cases brought in state and federal court. She has achieved pre-trial dismissals in all three of these class action cases, which involved pharmacy regulatory claims, consumer protection act claims, as well as a nationwide ERISA class action. She has successfully defended clients in securities fraud trials in both federal court and before the Tennessee Securities Division. She has experience representing clients before the Ninth Circuit Court of Appeals, the Sixth Circuit Court of Appeals, the California Supreme Court and the Tennessee Supreme Court. She obtained a decision from the Eleventh Circuit Court of Appeals affirming the pre-trial dismissal of a $25 million shareholder suit brought against a national healthcare company.
Ms. Weaver has written for various national publications on issues relating to healthcare fraud and investigations. Ms. Weaver co-authored a chapter entitled "Corporate Compliance Programs," in the ABA's Health Care Fraud and Abuse: Practical Perspectives, published by BNA books (Linda A. Baumann et al eds., 2004). She also co-authored "Voluntary Disclosure to the Government and the Resulting Litigation Dilemma" for the American Health Lawyers Association and "A Litigator's Approach to Internal Investigations" for the ABA's The Health Lawyer, Vol. 17, Number 1, March 2005.
Prior to joining the firm, Ms. Weaver practiced at the Los Angeles office of O'Melveny & Myers, focusing on white collar criminal defense, and was a judicial clerk for United States District Judge Joseph Goodwin in the Southern District of West Virginia.
