Jessica L. Lund is an associate located in the Century City office of Gibson, Dunn & Crutcher. She is a member of the Litigation Department, practicing primarily in the firm's Intellectual Property, Media, Entertainment and Technology, Antitrust and Trade Regulation, and Class Action and Complex Litigation practice groups. Ms. Lund has counseled clients regarding competitive business practices and intellectual property and rights of publicity issues in the film, television, theater, automotive, pharmaceutical, and health care industries. She has litigated First Amendment, trademark, copyright, false advertising, unfair competition, breach of contract, fraud, securities fraud, and consumer class action cases for clients in the entertainment, media, video game, investment banking, insurance, reinsurance, commercial real estate, and health care industries. She has significant trial and arbitration experience and has appeared before federal and state trial courts across the United States. Ms Lund has also represented clients in connection with investigations and proceedings before the SEC, the DOJ, the New York Attorney General, JAMS and the American Arbitration Association.
Specifically, since joining the firm in 2007, Ms. Lund has served as a principal member of the firm's litigation team on the following matters (among other efforts):
ˇ The successful representation of an entertainment studio in a three week arbitration relating to a profit participation dispute involving a highly successful and long-running television franchise, which resulted in an arbitration award completely in our client's favor.
ˇ The successful representation of a broadcast television network in a 10-day arbitration involving a profit participation dispute related to several highly successful television series brought by a major television studio, which resulted in an arbitration award vindicating our client's rights and obligations entirely.
ˇ The successful representation of a major film studio in an international profit participation arbitration related to several tax advantage film financing agreements with a major financial institution, which resulted in a beneficial settlement.
ˇ The successful representation of a major film studio in an investigation by the DOJ and foreign governmental authorities related to tax advantage film financing agreements.
ˇ The successful representation of a major online and infomercial retailer in a trademark infringement litigation in the Central District of California.
ˇ The successful representation of a major film studio in an interpleader action related to distribution agreements with defunct entities pertaining to various motion pictures.
ˇ The successful representation of a consulting company in an action brought against it, a municipality, and a retailer related to the allocation of local sales tax revenues, which resulted in the claims against our client being struck under California's law against Strategic Litigations Against Public Participation (Anti-SLAPP).
Prior to joining the firm, Ms. Lund served as a law clerk to Judge Robert L. Carter in the Southern District of New York and was an associate at the New York law firm of Cahill Gordon & Reindel LLP. She received her law degree cum laude in 2003 from New York University School of Law, where she was a Robert McKay Scholar, a teaching assistant to President John Sexton, and a member of the Intellectual Property and Entertainment Law and the International Law Societies. She graduated with High Distinction in 2000 with a B.A. degree in Political Science and Comparative Literature from the University of Michigan, where she was elected to Phi Beta Kappa, a member of the Golden Key National Honors Society, and the Pi Sigma Alpha; National Political Science Honors Society.
Ms. Lund is a member of the Association of Business Trial Lawyers and the intellectual property section of the California State Bar. She is admitted to practice law in the States of California and New York and before the United States District Courts for the Central and Northern Districts of California.
Ms. Lund also serves on the steering committee of the Los Angeles Public Library's Young Literati Committee and is a member of the Young Professionals' Leadership Group of the Center Theater Group.
