Joel Dion is a registered patent attorney and concentrates his practice in intellectual property litigation, prosecution, and counseling. He has experience litigating cases in jurisdictions throughout the country. Mr. Dion has successfully tried both patent and trademark cases before judges and juries and has presented argument at multiple claim construction (Markman) hearings in patent disputes.
Representative Matters
· Trial counsel for medical device manufacturer and patent holder in patent infringement action in the Eastern District of Pennsylvania resulting in successful pre-trial resolution of primary claims and favorable trial verdict dismissing all remaining counterclaims including inequitable conduct allegations.
· Secured favorable jury verdict on behalf of electrical products distributor accused of trademark infringement in the Southern District of Illinois.
· Represented indigent inmate in federal court jury trial relating to alleged constitutional violations during incarceration.
· Representation of patent holder for power-over-Ethernet technology in successful prosecution of patent infringement litigation in the Eastern District of Texas.
· Successfully defended major software manufacturer in patent infringement action in the Eastern District of Texas accused of infringing patents relating to supply chain management software. Obtained complete dismissal of all claims with prejudice.
· Successfully defended software company in patent infringement litigation involving customer relationship management software in the Eastern District of Texas.
· Representation of generic pharmaceutical companies in all aspects of patent litigation strategy and management including review of Orange Book patents, preparation of non-infringement and invalidity opinions, and assistance on ANDA litigation.
· Representation of multi-billion dollar software company in transactional matters including due diligence relating to acquisitions and divestitures, drafting review of patent, trademark, and other technology licensing, prosecution of patent and trademark applications and review of general commercial contracts.
· Counseling and litigation relating to Internet and e-commerce issues and domain name disputes.
· Drafting and negotiating intellectual property agreements, licenses, and confidentiality agreements.
