Professional Experience Jay Nolan has tried most types of commercial cases to juries and courts in state and federal courts around the country since joining the firm in 1969. In addition to securing verdicts or judgments in almost 100 cases, he has argued appeals in the Connecticut Supreme and Appellate Courts and the First and Second Circuits. He has extensive experience in cases involving disputes between owners of businesses. Jay has also represented institutional clients who have been victimized in sophisticated frauds perpetrated by debtors, investors and advisors. In addition to Jay's extensive commercial litigation experience, he started the firms insolvency practice in the early 1970s. He has represented institutional creditors, committees, and debtors over the last 35 years. Most recently, he has represented electric utilities in the bankruptcies that followed the deregulation of that industry. He has had extensive training and experience in all types of ADR. He is available for engagement as an arbitrator and mediator in commercial disputes. Representative Matters · Headed team that successfully defended the developer of a $185 million mixed-use project in a series of federal and state suits and administrative appeals brought by or on behalf of a NYSE shopping mall developer; West Farms Mall, LLC v. Town of West Hartford, et al., 279 Conn. 1 (2006) · Headed team that negotiated a $34 million settlement of suit for vexatious litigation and unfair trade practices for developer of mixed-use project against The Taubman Company and other owners of West Farms Mall · Led trial and appellate team that prevailed in multisuitor $3.5 billion contested takeover of integrated public utility in bankruptcy proceeding; In re Public Service Company of New Hampshire, 114 B.R. 820 (Bankr. D. NH 1988) · Obtained injunction in New Hampshire Federal Court against attempt by the state of New Hampshire to nullify a multiyear agreement setting electric rates; Public Service Company of New Hampshire v. Patch, 167 F.3d 15 (1st Cir. 1998) · Represented institutional investors in removing the general partner and investment advisor for fraud in a $100 million private equity fund in Delaware Chancery Court; Davenport Group MG, L.P. v. Ch. 1996) · Represented unsecured creditors' committee against advisors, management, and fully secured creditors in Chapter 11 case of firearms manufacturer establishing fraud and illegal conduct · Successfully settled fraud case on behalf of private equity fund brought in New York Supreme Court against seller of portfolio company · Prevented bankrupt electric generator from rejecting contract to supply majority of power for Connecticut utility's retail load.
