| Biography | Mr. Cracken represents individuals and businesses in the prosecution of class actions, mass actions, and related multidistrict litigation (MDLs). He serves as coordinating counsel, often responsible for (1) evaluating his client's options, (2) recruiting a team of law firms to jointly represent his client in the prosecution of his client's individual or representative claims, and (3) coordinating the related litigation from start to finish. Further, he often takes a leadership role with defense counsel, the court, and/or the neutrals in negotiating the structure and terms for the eventual resolution of his client's claims. Most recently, Mr. Cracken served as coordinating counsel in the joint representation of his clients in the prosecution of (1) state and federal court class actions by consumers to recover usurious overdraft fees paid in connection with use of their POS/debit and ATM cards, (2) state court mass actions by consumers to recover their damages resulting from negligent misrepresentations made by former directors, officers, and employees in connection with the sale of general-aviation jet aircraft, (3) approximately 70,000 individual state court actions by consumers to recover statutory damages as a result of the misuse of their private credit information, and (4) other civil actions; and, Mr. Cracken has served as coordinating counsel in actions pending in Georgia, Illinois, Missouri, New Mexico, and Texas. |
