John Fleming, who has twice served as Practice Group Leader of Sutherland's Litigation Practice Group, has more than 35 years of experience that encompasses a wide range of litigation areas. He has litigated in state and federal courts and focuses his practice on complex business litigation including securities litigation, professional liability litigation, intellectual property litigation, major litigation involving insurance companies and tax litigation. His diverse experience has served him well as an attorney and as an arbitrator in arbitration and other alternative dispute resolution mechanisms including international arbitration forums. Before joining the firm, John served as a law clerk in Dallas to the Honorable Irving Goldberg of the U.S. Court of Appeals for the Fifth Circuit. John also served for five years as an adjunct professor in the Pretrial Litigation course at Emory University Law School. Representative Experience John's extensive representative experience includes: · Serving from 1998 through 2007 as Eastern Regional Counsel for dealer and general litigation for a major automobile manufacturer, and as Southeast Regional Counsel for the previous five years. · Successfully representing a major hotelier in several lawsuits in the Southeast. · Serving as trial counsel in a successful nine-figure claim against the United States. · Successful motions to dismiss in defending federal securities claims. · Serving as respondent's counsel in a successful defense of a $90 million arbitration claim against a brokerage firm. · Successful 2010 jury verdict in federal court in Texas in trade secret/breach of contract case. · Achieving an arbitration award exceeding $55 million for an insurance company. · Handling an appointed death penalty case, from 1980 to 1992, in which death penalties were reversed once by the U.S. Supreme Court and three times by the Georgia Supreme Court, and finally rejected by a jury in a trial shown on "Court TV" in Madison, Georgia.
