John L. Cuddihy is a partner in the firm's Litigation Group and is resident in the Washington, D.C. office. He focuses his practice on complex commercial litigation, particularly intellectual property and antitrust disputes, in which he represents both corporate plaintiffs and defendants. He also has substantial experience representing European clients involved in litigation in the United States and in parallel proceedings abroad. Some of Mr. Cuddihy's recent matters include:
· Representation of a Class I railroad in defense of multi-district class action litigation alleging conspiracy to fix fuel surcharge prices.
· Representation of certain automotive filters manufacturers in defense of multi-district litigation alleging conspiracy to fix prices. The plaintiffs voluntarily dismissed their claims against the manufacturers.
· Representation of European automobile manufacturers in several patent infringement actions in New Jersey and Texas federal district courts.
· Representation of Enron Creditors Recovery Corporation (ECRC) in bankruptcy litigation against two international financial institutions, arising from the collapse of Enron Corporation in 2001. The litigation resulted in settlements for ECRC valued at over $2 billion.
· Representation of Fortune 100 corporation in class action litigation alleging conspiracy to fix the prices of various food additives. The court dismissed the action against the corporation.
· Representation of European bankruptcy trustees in breach of contract litigation in Virginia federal district court. The trustees won summary judgment on all claims and counterclaims.
· Representation of British and Delaware corporations in breach of fiduciary duty action in Delaware Chancery Court against former director and officer. The corporations won summary judgment on all claims and counterclaims.
· Representation of Dutch law firm in defense of breach of fiduciary duty action in District of Columbia federal district court. The court dismissed the action against the law firm.
· Representation of CEO of British charity in defense of civil RICO action in New York federal district court. The court dismissed the plaintiffs' claims against the CEO.
· Representation of United States telecommunications corporation in patent infringement actions in Massachusetts, North Carolina, and Delaware. The actions settled on confidential terms before trial.
· Representation of leading university in patent licensing dispute in District of Columbia federal district court. The action settled on confidential terms before trial.
John served as a law clerk to the Honorable Timothy B. Dyk of the United States Court of Appeals for the Federal Circuit in 2000 - 2001. He is a graduate of the School of Foreign Service at Georgetown University (B.S.F.S. 1992, cum laude) and the Georgetown University Law Center (J.D. 1999, cum laude).
Before becoming an attorney, John worked as a press officer for Ambassador Madeleine K. Albright at the United States Mission to the United Nations in New York, and as a speech writer for Governor James J. Florio of New Jersey.
