JORDAN S. WEINSTEIN, an intellectual property attorney, is a partner in the firm's Trademark and Copyright practice groups. Serving innovator clients whose business goals or challenges do not necessarily fit into the traditional framework of patent, trademark or copyright, he helps his clients evaluate their business models and then works to execute strategies that translate their competitive edge into legal advantage.
Mr. Weinstein's areas of practice include counseling, licensing and litigation in U.S. and international trademark, copyright, unfair competition, Internet and high-technology matters. He provides opinions on trademark and copyright availability and infringement, and has been engaged in numerous opposition and cancellation proceedings before the United States Patent and Trademark Office (USPTO), as well as appeals and infringement litigation. Mr. Weinstein has an extensive practice before the Trademark Trial and Appeal Board (TTAB) of the USPTO, where he has represented clients in oppositions, cancellations and concurrent use proceedings, and appeals to the U.S. Court of Appeals for the Federal Circuit and to U.S. district courts.
Mr. Weinstein's clients span many industries, including retail foods, restaurants, clothing, sports and recreation, electronics, software, jewelry, satellite systems, and advertising and marketing. He works closely with clients on launching, assessing and protecting packaging, branding and Internet designs. A pioneer in domain name disputes, he represented the City of Barcelona in one of the first lawsuits under the Anticybersquatting Consumer Protection Act (ACPA), which established the law applied to multi-jurisdictional cases. He also played a pivotal role in the establishment of law clarifying the procedure for obtaining in rem jurisdiction over a domain name in the Eastern District of Virginia, home of many anticybersquatting cases.
For the past decade, Mr. Weinstein has been an arbitrator for domain name disputes under the Uniform Domain Name Dispute Resolution Policy. In addition, the World Intellectual Property Organization (WIPO) and Disputes.org have appointed Mr. Weinstein to their panels of qualified arbitrators for domain name disputes.
Mr. Weinstein conducts an annual review of all the registrability cases handed down by the TTAB and its reviewing court, the U.S. Court of Appeals for the Federal Circuit, reading, briefing and digesting all of the decisions and analyzing their impact on the industry. This review is published in the industry's scholarly journal - "The Trademark Reporter"- of the International Trademark Association (INTA). He also gives the keynote address at the association's annual meeting. Additionally, Mr. Weinstein assisted in preparing INTA's testimony before Congress on the Madrid Protocol Implementing Act, H.R. 2129, chaired the Madrid Protocol Implementing Legislation Team, and testified before the Virginia Senate on INTA's behalf for the Model State Trademark Bill (S.B. 1084).
Mr. Weinstein has authored several monographs and articles on intellectual property and computer issues, published in national and international journals. He lectures extensively on U.S. and international trademark law, practice and litigation, and on protecting intellectual property in the apparel, sporting goods, healthcare, and Internet fields.
