Joseph D. Capitan is the head of the disability department at Martin Law and focuses his practice entirely on Social Security Disability and Long-Term Disability (ERISA). He handles Social Security disability hearings before Administrative Law Judges in Pennsylvania, New Jersey, and Delaware. He also handles Social Security disability cases pending before the Appeals Council. Mr. Capitan represents individuals who have been denied long term disability benefits at the administrative level with the insurance company and in federal court.
Mr. Capitan also devotes much of his time to Continuing Legal Education (CLE). He was a faculty member of a program held in 2013 entitled “Social Security Disability: From Start to Finish.” He is a frequent speaker at community events as well as Social Security Disability Committee meetings for the Philadelphia Bar Association. In April 2015, Mr. Capitan started his own monthly CLE program entitled “Social Security Disability Boot Camp.” The course reviews how to identify a Social Security disability case, explains Social Security’s standards of disability as well as its five-step process, and provides an overview of how to handle cases before an Administrative Law Judge.
Prior to joining the firm, Mr. Capitan was a contract negotiator for a research company. In 2006, Mr. Capitan earned his law degree from the University of Miami School of Law, where he was a research assistant. He also clerked for the Kent County Attorney General’s Office. He earned his bachelor’s degree in English from Bucknell University in 2003.
