Joshua N. Howley is a Member of the Firm's Litigation Practice Group. He has handled complex litigation matters involving the representation of multinational corporations and financial institutions in federal and state courts. He has worked on a wide array of business and commercial disputes including securities fraud, consumer fraud, breach of contract, breach of fiduciary duty, professional malpractice, and commercial and residential foreclosures. Mr. Howley also regularly defends financial institutions for alleged violations of TILA, RESPA, HOEPA, FDCPA and FCRA.
Prior to joining the Firm, Mr. Howley was an associate with the law firm of Skadden, Arps, Slate, Meagher & Flom LLP from 2002-2006. Prior to joining Skadden Arps, Mr. Howley was a law clerk to the Hon. Charles J. Walsh, New Jersey Superior Court, Civil Division.
Mr. Howley has been appointed by the New Jersey Supreme Court to a four-year term beginning in September 2009 on the District V-A Ethics Committee. He also serves on the Firm's Professional Relations Committee.
Representative Matters
· Winning a bench trial and the dismissal with prejudice of fraudulent transfer claims against an investment advisor and an individual.
· Securing summary judgment in a commercial foreclosure action on behalf of a syndicate of lenders in connection with a $72 million loan
· Obtaining a voluntary dismissal on behalf of a Fortune 100 financial institution before discovery of a cause of action under N.J.S.A. 12A:4-302 claiming the late return of a check.
· Representing a Dallas-based real estate asset manager in commercial foreclosures, workouts and restructurings of loans secured by real property in New Jersey and New York.
