Biography

A member of Husch Blackwell's Healthcare, Life Sciences & Pharmaceuticals team, Julianne navigates clients through the ever-changing landscape of labor and employment law. In particular, hospital administrators, medical directors and health insurance executives look to her for business critical guidance in matters involving discrimination, harassment, disability, accommodations and employee leave under the Americans with Disabilities Act (ADA) and Family and Medical Leave Act (FMLA). Notably, Julianne has obtained summary judgment in federal court on behalf of defendant employers in lawsuits involving allegations of discrimination, harassment, FMLA, retaliation and wage and hour violations.

As part of her general labor and employment practice, Julianne negotiates, drafts and litigates employment agreements and restrictive covenants. She also represents employers in mediations and arbitrations involving employment-related issues and helps employers design and implement effective dispute resolution procedures.

Julianne regularly conducts human resources audits, policy reviews and training sessions on effective human resources practices. She also counsels employers regarding day-to-day workplace issues involving harassment, discrimination, accommodation and leave under FMLA, ADA and privacy laws, as well as federal and state wage and hour regulations.

Experience
•Achieved affirmation of a dismissal from the 8th Circuit of a consolidated class and collective action against defendant in a Fair Labor Standards Act case involving employment contracts and training.
•Assisted SCL Health System in the sale of Providence Medical Center in Kansas City, Kan., and Saint John Hospital in Leavenworth, Kan., to California-based Prime Healthcare Services. Transaction completed less than three months after Prime Healthcare was selected as the preferred bidder in a nationwide auction process.
•Represented Springfield, Mo.-based CoxHealth in completing an affiliation transaction with Skaggs Regional Medical Center in Branson, Mo.
•Defended medical practice and its 11 physician shareholders in a $15 million lawsuit filed by a former employee and shareholder after client's internal investigation established plaintiff had behaved inappropriately with two female employees. Obtained summary judgment on all but one claim. At trial, jury awarded the plaintiff the lesser amount of stipulated damages and awarded judgment in client's favor on a related indemnification claim and awarded client attorneys' fees and expenses.
•Obtained summary judgment on behalf of defendant employer in a putative class action case alleging violations of the Indiana Wage Payment Act based on the timing of bonus payments.
•Defended major tax services company in lawsuit filed by former employee who alleged the company had breached her employment agreement, terminated her in violation of public policy and denied her bonuses, commissions and overtime when it terminated her employment. Obtained summary judgment in client's favor in trial court which was affirmed on appeal.
•Defended group of nursing homes and their management company in Fair Labor Standards Act lawsuit where plaintiffs alleged they missed meal breaks automatically deducted from their pay. Achieved favorable outcome for client.
•Defended long-term care facility in sexual harassment claim brought by kitchen employee against department manager, which included allegations of sexual misconduct by the director of the facility. Achieved favorable resolution for client.
•Defended long-term care facility in sexual harassment claim brought by patient care assistants based on inappropriate conduct of their alleged supervisor. Achieved favorable resolution for client.
•Defended hospital in whistleblower and discrimination claim brought by former nurse alleging understaffing following the termination of her employment for poor work performance. Achieved favorable outcome for client.
•Defended hospital in harassment claim brought by a housekeeping employee against an executive and achieved favorable resolution for client.
•Advised hospitals and other healthcare clients on a variety of state and federal wage and hour issues, including lunch breaks, travel time and overtime.
