Julie has a range of experience in intellectual property legal matters, which she has practiced exclusively since 1990. She works primarily on trademark, copyright, patent, trade secret and unfair competition matters. Julie has litigated patent infringement, trademark, trade dress, trade secret, copyright and unfair competition matters spanning various technologies and industries. Julie has extensive knowledge concerning the procurement of U.S. and international trademarks and U.S. copyright registrations, as well as protecting those rights through the U.S. Customs system to stop parallel imports and counterfeits at U.S. borders. She works with matters before the Trademark Trial and Appeal Board, including opposition and cancellation proceedings to protect clients' trademark rights. Julie has represented companies of all sizes, as well as individuals, in enforcing their intellectual property rights and in defending against alleged violations of the intellectual property rights of others. Julie's responsibilities with trademark, trade dress and copyright prosecution include counseling and licensing as well as litigation in all of these areas. This aspect of her practice focuses on identifying, defining and maximizing clients' intellectual property rights; preparing trademark opinions regarding use and registrability; counseling and monitoring to confirm that intellectual property is used properly and effectively; negotiation and drafting of licenses, agreements and transactions relating to those rights obtained, domestically and internationally; creating enforcement programs and procedures that promote effective use of intellectual property and policing against improper use of intellectual property by others; and providing opinions and establishing policies and procedures for individuals and companies to avoid conflicts with intellectual property rights of others. In the area of trademark litigation, Julie has had extensive worldwide experience in protecting a well-known mark in the toy industry. She also works in the area of domain name disputes and trademark mediation and has had responsibility for copyright litigation concerning video game rights, computer software rights and copyrights in toy designs. In the area of patent infringement litigation, Julie has had responsibilities in complex litigation involving patents covering antibiotics, hard disk drive motors and audio equipment. With respect to trade secrets, Julie works with clients to protect trade secrets through copyright registration and preemptive litigation strategies. In the area of patent litigation, Julie has had extensive experience litigating Hatch-Waxman Act/ANDA patent infringement actions involving prescription pharmaceutical drugs, including successfully invalidating the patent on Floxin Otic® (ofloxacin) (Daiichi Sankyo Co., Ltd. v. Apotex, Inc. et al., 501 F.3d 1254 (Fed. Cir. 2007). Prior to joining the firm, Julie practiced law with the intellectual property firm, Pitts & Brittian, P.C. in Knoxville, Tenn., where she was primarily involved in patent and trademark infringement litigation and franchise and copyright matters.
