Ms. Weingart's primary areas of practice are federal black lung, workers' compensation and general litigation.
Representative Experience
· Defense of employers in workers' compensation claims related to occupational disease, occupational pneumoconiosis, hearing loss and injury
· Representation of employers in appellate proceedings before the Office of Judges, Workers' Compensation Board of Review and the West Virginia Supreme Court of Appeals, including oral arguments before the Supreme Court
· Defense of employers at all levels of litigation related to Federal Black Lung claims
· Provide advice and training to third-party administrators, insurance companies and self-insured employers regarding West Virginia workers' compensation law, claims administration and litigation
· Coordination of defense of mass filings of workers' compensation occupational disease claims related to asbestos exposure filed with the Ohio Industrial Commission
· Drafted legislation for workers' compensation reform before the West Virginia Legislature in 2003
· Defense of class action product liability and toxic tort lawsuits
· Served as defense liaison counsel in asbestos litigation in both a national counsel and local counsel capacity
· Taught legal communications, written and oral advocacy, at The University of Akron School of Law
