Kathy Yarbrough, a member of Sutherland's Energy and Environmental Practice Group, has more than 20 years of experience representing clients in the natural gas, liquefied natural gas (LNG), environmental and energy commodities areas. In the LNG area, Kathy has assisted major LNG importers and terminal developers in developing commercial arrangements for LNG importation and import terminal capacity, as well as in securing all necessary regulatory approvals from the Federal Energy Regulatory Commission (FERC) and the U.S. Department of Energy (DOE). In the natural gas area, Kathy has represented industrial consumers of natural gas and gas marketers before FERC and several U.S. Courts of Appeals and has counseled clients in the development of natural gas pipeline and storage facilities, in related commercial and contractual agreements, and regarding regulatory approval requirements. Her LNG and natural gas practices encompass all aspects of rate, certificate and policy issues, as well as legislative and environmental initiatives that have implications for LNG and natural gas.
In her environmental practice, Kathy advises clients on compliance with federal and state environmental regulations affecting petroleum products importers, refiners and traders, and she counsels them in enforcement-related issues. She also advises clients on legislative initiatives affecting the petroleum industry and trading areas and on energy commodities contractual and regulatory matters.
Kathy also has significant experience in federal budgetary, regulatory and policy matters. She served in the Executive Office of the President from 1972 through 1983, primarily in the White House Office of Management and Budget as a Budget Examiner and Policy Analyst.
Representative Experience
Kathy's extensive representative experience in the LNG and natural gas arenas includes:
· Providing regulatory counsel on behalf of a major LNG importer with respect to the negotiation of capacity arrangements and regulatory framework at the reactivated multi-shipper Dominion Cove Point LNG, LP terminal. She also has assisted with related implementation, rate and policy issues since reactivation.
· Serving as regulatory counsel on behalf of a major LNG importer in negotiations and preparation of commercial documents for exclusive participation in the proposed Dominion Cove Point terminal expansion and related multi-pipeline expansions. She also has assisted with subsequent regulatory proceedings seeking FERC approvals and certificate authorizations.
· Providing regulatory counsel for LNG clients for analysis of federal regulatory issues affecting LNG importation and natural gas matters, including Natural Gas Act Sections 3 and 7 issues; Hackberry Policy issues; other approvals and certificate issues; and rate, storage, transportation and other policy issues.
· Serving as counsel on federal LNG certificate and regulatory issues to Northeastern Governor's Staff.
· Serving as counsel on federal LNG certificate and regulatory issues to New England and other LNG terminal developers.
· Providing regulatory counsel for securing DOE import authorizations.
· Providing counsel in advising various clients regarding commercial and regulatory aspects of gas storage projects.
· Serving as counsel to Process Gas Consumers Group and other industrial clients on many interstate pipeline systems and in many FERC proceedings.
· Serving as counsel for industrial natural gas bypass counseling and regulatory matters and analysis of federal/state jurisdictional issues.
· Providing counsel on natural gas contract issues.
· Providing counsel for industrial groups in many FERC rule-making proceedings and in resulting appellate court cases.
