Kenneth Appleby is a partner with Foley & Lardner LLP, where he is a member of the firm's Taxation, Estates & Trusts, and Private Equity & Venture Capital Practices. He has a broad tax practice which encompasses the areas of federal, state and international taxation. Mr. Appleby advises clients concerning the tax aspects of both domestic and international merger and acquisition transactions; private equity and real estate fund formation and investments; tax optimized structures for the creation, holding and disposition of intellectual property; the design and implementation of tax efficient structures for real estate development and corporate transactions; like-kind exchanges and syndicated tenant's-in-common offerings; equity and deferred compensation plans; joint ventures; formation and operation of exempt entities; and multi-state tax planning (with a particular emphasis on state taxation of intellectual property). Mr. Appleby's practice also includes sophisticated estate planning for high net worth individuals and succession planning for closely held businesses.
Mr. Appleby has been Peer Review Rated as BV® Distinguished™, a mark of excellence in Martindale-Hubbell's peer review rating system. In 2006 and 2007, he was selected for inclusion in the Massachusetts Super Lawyers lists, an honor received by only 5% of Massachusetts attorneys. He was recently elected by his peers for inclusion in The Best Lawyers in America® 2012.
Prior to joining Foley, Mr. Appleby practiced with both national and regional law firms and has over 25 years of experience. He is co-author with Marvin Petry of Taxation of Intellectual Property and Technology, a two volume treatise published by LexisNexis. Mr. Appleby is also the author of numerous articles on various federal income tax topics that have been published in both scholarly journals and in the popular press, and is a frequent and nationally-known lecturer on a variety of tax-related topics.
A graduate of American University Law School (JD, cum laude, 1985), Mr. Appleby received dual bachelor's degrees from Syracuse University in both accounting and transportation management (BS, 1982). Mr. Appleby is a member of the Massachusetts, District of Columbia, Maryland and Vermont bars and was previously the co-chair of the Boston Bar Association Tax Section.
