Kevin McElcheran is a partner in our national Bankruptcy & Restructuring Group, based in the Toronto office.
Mr. McElcheran is a leading insolvency lawyer experienced in all areas of insolvency practice and has been certified by The Law Society of Upper Canada as a specialist in bankruptcy and insolvency law since 1996. Mr. McElcheran uses creativity, commercial expertise and strong advocacy skills to advance the interests of debtors, creditors and other stakeholders with positions of critical importance in large restructuring and insolvency cases. He also acts as an insolvency advisor in complex securitization and derivatives transactions.
His recent significant engagements include acting as counsel for the senior lenders' agents in each of the Abitibi-Bowater and Grant Forest Products CCAA cases, as counsel for Goldman Sachs in the Canwest Media restructuring, as Canadian counsel for Avaya in its acquisition of the Enterprise Solutions business from Nortel and as counsel for Canada's five largest Banks in the $32 billion Asset Back Commercial Paper restructuring.
Mr. McElcheran is the author of Commercial Insolvency in Canada, published by LexisNexis Butterworths in 2005 and its second edition, published in 2011. He has lectured extensively on matters of insolvency law at programs sponsored by The Law Society of Upper Canada, the Ontario Bar Association, Canadian Institute and Insight Information, and has published papers on a variety of topics related to insolvency law.

Mr. McElcheran is a member of The Advocates' Society, the Canadian Insolvency Foundation, Insolvency Institute of Canada, the American Bankruptcy Institute, the Turnaround Management Association and INSOL International.
He received his BA (Hons.) from the University of Toronto in 1976, and his LLB from Queen's University in 1980. He was called to the Ontario bar in 1982.
