Biography

Kori Termine Wisneski is an associate in the firm's Litigation Group, where she focuses her practice on complex commercial litigation matters in state and federal courts, working on behalf of both plaintiffs and defendants. In addition, she has expanded her practice to include labor and employment matters, insurance coverage litigation, subpoena counseling, personal injury matters, and criminal defense.

Ms. Wisneski has a broad base of experience both in and out of the courtroom. She has aided in the successful resolution of several complex cases in formal and informal settings, examined and cross-examined witnesses in court, taken numerous depositions, and argued motions in state and federal courts. Ms. Wisneski also has argued and won summary judgment on behalf of corporate clients in both insurance coverage and employment cases. In 2009, she was an active participant in a jury trial defending one of the world's leading pharmaceutical companies in a premises liability action where the plaintiff was claiming catastrophic injuries, including a broken neck. After nine days of evidence and the introduction of testimony from six expert witnesses, the jury found on behalf of her client on all counts.

Ms. Wisneski is also very active in the community. She is the cochair of the Women in Law Committee of the Young Lawyers Section of the Connecticut Bar Association (CBA), on the Board of Directors of the Middlesex YMCA, and an adjunct faculty member for the University of Connecticut School of Law, where she teaches the class Lawyering Process. Currently, Ms. Wisneski is in the process of planning a women's professional golf event in conjunction with the CBA, which will introduce female attorneys to the usefulness of golf in networking.

While attending law school, Ms. Wisneski was a judicial intern in the chambers of United States District Court Judge Janet C. Hall. She also interned in the U.S. Attorney's Office in Bridgeport, Connecticut.

Experience

Complex Litigation

- Obtained defense verdict for one of the world's leading pharmaceutical companies in a personal injury case. The plaintiff in that case alleged that her catastrophic injuries, including a broken neck, were caused by a dangerous condition of a stairway and/or the negligence of the company. After nine days of evidence, the jury returned a verdict in favor of our client on all counts.

- Won summary judgment in case where insured was seeking coverage for loss he allegedly sustained when the city demolished his property on the grounds that such damage was excluded under the ordinance or law provision of the policy.

- Won summary judgment on behalf of national manufacturing company in employment discrimination case initiated by former employee on the grounds that he was terminated on the basis of his race and/or national origin in violation of Title VII and the Connecticut Fair Employment Practices Act. In addition to dismissing these statutory claims, the court also dismissed plaintiff's common law claims, including intentional infliction of emotional distress and fraudulent misrepresentation.

- Successfully represented a worldwide seller of sports nutrition products in an action against a contract manufacturer and formulator of a protein drink after the product had to be withdrawn from the market due to contamination in the manufacturing process.

- Representation of a personal finance and small business financial services company in a Connecticut state case pertaining to unfair debt collection practices.

Criminal Litigation

- Successfully negotiated dismissal of client's DUI charge after challenging the admissibility of the state's evidence on both procedural and substantive grounds. Represented various clients in state court on misdemeanor criminal matters, including DUI and drug possession charges.

- Served on trial team for Connecticut's former Senate minority leader in the first-ever Bipartisan Committee of Review.

- Currently serving on defense team for criminal client facing murder charges in the United States District Court for the District of Connecticut.

Employment Litigation and Counseling

- Represented Connecticut-based mill in an appeal initiated by former employee seeking unemployment compensation benefits before the State of Connecticut Employment Security Appeals Division. After a hearing on whether the employee was discharged for willful misconduct in the course of his employment, and therefore ineligible for such benefits, the appeals referee issued an opinion in favor of the mill, denying benefits to the employee.

- Represented town in administrative proceedings against its chief of police concerning alleged misconduct. Worked on team that successfully negotiated resolution of matter in best interest of town and its citizens.

Pro Bono

- Representing a domestic violence shelter on several pro bono matters, including opposing subpoenas issued by the Connecticut Department of Children and Families seeking privileged client information.

- Successfully represented pro bono client in small claims trial against former landlord for return of her security deposit. Double damages were awarded.

- Successfully negotiated resolution on behalf of pro bono client who initiated an action in Connecticut State Court against two local companies for breach of contract and violations of the Uniform Commercial Code, as well as violations of the Connecticut Unfair Trade Practices Act, when his sculptural art piece, which the companies fabricated and powder-coated, began to rust within a short period of time after being installed.

- Submitted amicus brief to the Connecticut Supreme Court in landmark case, Kerrigan, et al. v. Conn. Dept. of Public Health, et al.
