With little fanfare, on May 21, 2008 the Federal Trade Commission published a new final Rule that is certain to find unwary advertisers in violation of the CAN-SPAM Act (the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003, codified at 15 U.S.C. § 7701 et seq.)
